  • Acceptance of Terms
    Welcome to FlyEyes! These Terms of Use ("Terms") govern your use of the FlyEyes website (the "Site") and any services, features, content, or applications offered by FlyEyes (collectively, the "Services"). By accessing or using the Site or Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Site or Services.
  • Changes to the Terms
    FlyEyes reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.
  • Use of the Site and Services
    The Site and Services are intended for use by individuals who are at least 18 years old. By using the Site or Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. You agree to use the Site and Services in compliance with all applicable laws, rules, and regulations.
  • User Accounts

    The Site and Services, including all text, graphics, images, logos, icons, software, and other materials, are the property of FlyEyes or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site or Services, except as follows:
    • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
    • You may store files that are automatically cached by your web browser for display enhancement purposes.
    • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
    • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
  • User Content

You retain ownership of any intellectual property rights that you hold in the User Content. By submitting User Content, you grant FlyEyes a worldwide, non-exclusive, royalty-free, fully paid up, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in any and all media or distribution methods (now known or later developed). You represent and warrant that you own or control all rights in and to the User Content and have the right to grant the license granted above to us and our licensees, successors, and assigns. You further represent and warrant that all of your User Content does and will comply with these Terms.
  • Prohibited Conduct
    You agree not to engage in any of the following prohibited uses of the Site or Services:
    • Violating any applicable laws, rules, or regulations in connection with your use of the Site or Services.
    • Posting, transmitting, or distributing content that is illegal, obscene, defamatory, libelous, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable or harmful.
    • Infringing or violating the intellectual property rights or other rights of any other person or entity.
    • Harvesting or collecting email addresses or other contact information of other users from the Site or Services by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
    • Using the Site or Services in any manner that could disable, overburden, damage, or impair the Site or Services or interfere with any other party's use of the Site or Services.

    • Using any manual process to monitor or copy any of the material on the Site or Services or for any other unauthorized purpose without our prior written consent.
    • Using any device, software, or routine that interferes with the proper working of the Site or Services.
    • Introducing any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

    The Site or Services may contain links to third-party websites or services that are not owned or controlled by FlyEyes. FlyEyes has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that FlyEyes shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
  • Disclaimer of Warranties
    THE SITE AND SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.   • Limitation of Liability
    NEITHER FLYEYES NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE OR SERVICES WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE SERVICES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FLYEYES HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT WILL FLYEYES'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE OR SERVICES EXCEED THE AMOUNTS YOU HAVE PAID TO FLYEYES FOR USE OF THE SITE OR SERVICES OR ONE HUNDRED DOLLARS ($100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO FLYEYES, AS APPLICABLE. THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN FLYEYES AND YOU.
  • Indemnification
    You agree to defend, indemnify, and hold harmless FlyEyes, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or Services, including, but not limited to, your User Content, any use of the Site's or Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site or Services.
  • Governing Law
    These Terms and any action related thereto will be governed by the laws of India without regard to its conflict of laws provisions.
  • Dispute Resolution
    Any dispute arising out of or relating to these Terms or the Site or Services will be subject to the exclusive jurisdiction of the courts located in India, and you and FlyEyes consent to the personal jurisdiction of such courts.
  • Miscellaneous
    These Terms and any rights and licenses granted hereunder may not be transferred or assigned by you, but may be assigned by FlyEyes without restriction. Any attempted transfer or assignment in violation hereof shall be null and void. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and FlyEyes's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. These Terms, together with any other legal notices and agreements published by FlyEyes via the Site or Services, constitute the entire agreement between you and FlyEyes concerning the Site or Services. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third-party beneficiary rights upon any other person or entity.
